1310 Acceptable Use Policy

 

In this Acceptable User Policy or “AUP”,  You will see word that begin with capital letters, these particular words have the meanings set out in the terms and conditions unless We give them different meanings below.

 

Please read this AUP carefully as it applies to Your use of the Service. 

 

The purpose of Our AUP is to protect all of Our customers including You by ensuring certain activities are prohibited when using the Service.  It mainly focuses on the most severe misuse of the Service, such as

  • Illegal activities;

  • Unlawful activities;

  • Inconveniencing other internet users’ use of the services.

 

We may amend, modify or substitute this AUP at any time. Your continued use of the Service after any such amendment, modification or substitution means that You accept the new AUP.  We recommend that You visit Our website (www.1310.io) regularly to check for any updates or amendments to this AUP.

You have agreed that You will only use the Service for personal purposes and not for business purposes. 

Security

You are responsible for the security of the information You send and receive over the Service. We are not responsible for the consequences of your failure to employ adequate security measures (e.g. lost or corrupted files, identity theft, fraud) in respect of that information.

If We identify that of Your own devices used to use the Service are causing significant impact to the Service or Our network or are part of a “botnet” (machines hijacked by others to distribute malicious software or other forms of abuse), We reserve the right to suspend or disconnect the Service without notice.

You must ensure that Your own devices are protected with up-to-date anti-virus software and a properly configured firewall as a minimum where applicable.

You must keep Your password(s) confidential and secure. If You think that Your password(s) has become known to any unauthorised person or may be used in an unauthorised way You should take steps to change Your password immediately. If You believe that any of Your devices have been used to breach the terms of this Acceptable Use Policy You must inform Ss immediately.

 

Use of the Service

You are responsible for the way the Service are used and You are responsible for ensuring that Your use of the Service is within the law.

Unless We have agreed otherwise with You on the Order Confirmation, the Service is not subject to  a usage cap, nor are there any ‘traffic management caps’ in respect of the Service.

You must not use the Service, or allow anyone else to use the Service to carry out any of the following acts:

  1. Send a message or communication that is offensive, abusive, defamatory (damages someone’s reputation), obscene, menacing or illegal;

  2. Cause annoyance, nuisance, inconvenience or needless worry to, or interfere with the rights of, any other person;

  3. Perform any illegal activity;

  4. Break, or try to break, the security of anyone else’s equipment, hardware or software;

  5. Deliberately receive, use, own, post, transmit or publish obscene material (including, but not limited to, child pornography);

  6. Upload, post, publish or transmit any information or software that is protected by copyright or other ownership rights without the permission of its owner;

  7. Copy or distribute any software that we provide (but You may make a backup copy of any software that We provide for your personal use);

  8. Use any Internet Protocol (IP) address that We have not assigned to You. You may not use the internet connection we provide to harm the service of another internet user or impersonate another user, whether on Our network or external to Our network. You acknowledge that We may change your Internet Protocol (IP) address from time to time without giving notice unless You have purchased a fixed IP address from us;

  9. Use the Service in a way that (a) risks degradation of service levels to Our other customers, (b) puts Our systems at risk or (c) interferes with or attempt to interfere with the operation of any of Our equipment , the Equipment or the Service or the Internet;

  10. Knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

  11. Run open mail relays or open web proxies or similar services that can allow unknown third parties to use Your connection for (possibly) commit unlawful acts without Your knowledge or control;

  12. Modify identifying network header information in order to deceive or mislead;

  13. For business purposes.

 

This list is not exhaustive and any act which adversely affects either Us or a third party may result in Us suspending or terminating the Service in accordance with the Contract.

 

Usenet news usage

The Service allow access to many usenet discussion groups (“newsgroups”). You acknowledge that some newsgroups contain language, media or discussion of subjects intended for adult audiences. We do not monitor access to newsgroups or the content of posts by our other customers or customers at other sites. We are therefore not responsible for the content of any posting made to the newsgroup. In addition to the rest of this AUP, the specific terms relating to newsgroup usage are as follows:

·         We reserve the right to discontinue access to any newsgroup at any time and for any reason;

·         We will investigate complaints regarding posts of inappropriate material to newsgroups by users and may, at Our sole discretion, take action. Criteria for determining whether a post is inappropriate include (without limitation):

(a) the written charter of the newsgroup(s) in question;

(b) the established newsgroup(s) conventions outlined below;

(c) the system resources consumed by the posting; and

(d) applicable laws.

newsgroup news articles posted using the Service must comply with the written charter of the newsgroup to which they are posted. If a newsgroup does not have a charter, its title or recent content may be considered sufficient to determine the general topic of the newsgroup. You are responsible for determining the rules of a newsgroup before posting to it.

You may post advertisements only in those newsgroups that specifically permit them in the charter. Some newsgroups may permit “classified ads” for single transactions between private individuals, but not commercial advertisements. You are responsible for determining whether or not a newsgroup permits such non-commercial advertisements before posting.

You may not alter the headers of posts to newsgroup(s) to mislead other Internet users as to the origin of the posting. This includes but is not limited to, pre-loading the path, using another user’s details, using an incorrect “Date:” line. Using an invalid “From:” address for the purposes of combating e-mail spam messages that would otherwise be sent to You is not considered to be misleading. We may cancel newsgroup articles posted via our servers if they breach this AUP. You should not cancel newsgroup articles of any third party without the express consent of such third party. You may not use Our resources to cancel articles that you did not post. The sole exception to this rule is for moderators and retro-moderators of formally moderated newsgroups or newsgroups specifically allowing this in their charter, in which case the moderator or retro-moderator of a newsgroup may cancel any articles in a newsgroup he or she is moderating.

You may not attempt to “flood” or disrupt newsgroups. Examples of disruptive activities include posting multiple messages with no text in the body, or posting many follow-ups to messages with no new text.

 

Email use

It is your responsibility to back up the contents You create and store using the Service. Upon suspension or termination of the Service such contents may be removed and permanently deleted by Us without notice.

Complaints

We may receive a complaint about your use of the Internet. If it comes through a formal legal process (e.g. a Court Order) then We will follow the appropriate legal steps. However, we may receive an informal complaint about Your use of the Internet (an abuse complaint to abuse@1310.io that indicates You may not be following this Acceptable Use Policy. We will contact You to investigate, but where We are required by law or to protect Our interests or the interests of a third party or You are not able to satisfy Our investigation, then We reserve the right to suspend or terminate the Service immediately.
